The purchase of any product on the SmartWayMl online store implies the consumer's agreement to all terms and conditions of this Product Sales Agreement.

Considering that:

I - SmartWayMl is a company whose main activities consist of intermediating products via the internet; II - The user is an individual or legal entity, duly registered with CPF/MF or CNPJ/MF, with correctly filled out registration, whose information has been validated by SmartWayMl; III - The user declares to be acting in good faith and in the enjoyment of their civil capacity to enter into this Agreement, declaring that they understood, read, and agree to all terms and conditions provided herein.

PROCEDURES OF PURCHASE AND SALE

Clause One: After placing an order for products on the online store, the user must wait for the receipt of a notification via email informing them of the confirmation of the requested commercial transaction.

Paragraph One: SmartWayMl reserves the right not to confirm the purchase and sale in cases of:

I - User with incorrect or invalid registration information; II - Deliveries to be made outside the delivery areas made available by SmartWayMl at the time of purchase and sale; III - Fraud and bad faith, breach of any of the website's conditions and policies, abuse of rights, and/or other situations that imply a violation of legal provisions or unjust enrichment by the user and in other situations provided for by applicable law.

Clause Second: The value of the purchase and sale will be present in the confirmation email, and the user will be provided with the payment methods provided on the SmartWayMl website at the time of purchase and sale.

Paragraph One: Payment by credit card may not be approved if there is inconsistency in the cardholder's data. The bank slip generated for payment will be valid for 03 (three) business days, automatically canceled if payment is not made within said period.

RIGHTS AND OBLIGATIONS

Return for Repentance

Clause Third: The return of products due to repentance can be made within 7 (seven) calendar days, counted AFTER THE RECEIPT OF THE PRODUCTS.

Paragraph One: To exercise repentance, the user must contact SmartWayMl, by the customer service email smartwayml@gmail.com.

Paragraph Two: After sending the repentance email, the user must wait for our team's contact, which will inform the necessary procedures for item replacement or refund of the amounts paid.

Paragraph Three: The return provided for in this clause will only be approved by SmartWayMl after:

I - The actual return of the product to the supplier's distribution center; II - Confirmation by SmartWayMl that the product has been returned unused, in its original packaging, accompanied by labels, manuals, and accessories; III - Approval of the exchange or return by SmartWayMl's quality control, after analysis to be carried out within 10 business days.

Paragraph Four: If the user exercises repentance contrary to this clause or contract and/or if any divergence or violation of the returned product is identified, the return will not be accepted, and the product will be returned to the user without prior notice.

EXCHANGE DUE TO PRODUCT DEFECT OR FAULT

Clause Fourth: The exchange of products that present manufacturing defects or faults can be made provided that the request is made within the legal warranty period after receiving the products, according to article 26 of the Consumer Protection Code.

Paragraph One: To exercise the exchange, the user must contact SmartWayMl by the customer service email smartwayml@gmail.com.

Paragraph Two: The exchange provided for in this clause will only be approved by SmartWayMl after:

I - The actual return of the product to the supplier's distribution center; II - Confirmation by SmartWayMl that the product has been returned together with manuals and accessories; III - Approval of the exchange or return by SmartWayMl's quality control, which will be carried out after analysis within 10 business days.

Paragraph Three: If the user makes the product exchange contrary to this clause and/or if any divergence or violation of the product is identified, the return will not be accepted, and the product will be returned to the user without prior notice.

REFUND PERIOD

Clause Fifth: In the event of payment being made by credit card, the refund will be made to the credit card itself and will be visible to the user within 2 (two) billing cycles after the refund is completed, which may vary according to the card's due date. Payment for products made by bank slip will be reimbursed to the user's own account with the financial intermediary.

DELIVERY TIME AND CONDITIONS

Clause Sixth: Products are delivered from Monday to Friday, from 8 am to 9 pm, and the estimated delivery time will only start after payment confirmation and logistic processing.

Paragraph One: The product delivery service is carried out solely and exclusively by Correios (Brazilian Postal Service), which is also responsible for complying with delivery deadlines and stages to the user.

Paragraph Two: Delivery can be made directly to third parties, such as porters or relatives.

Paragraph Three: Delivery may not be made within the stipulated time due to:

I - User absence at the specified address; II - Incorrect registration data; III - User or third-party product refusal; IV - User address change; V - Occurrence of any force majeure event, such as floods, natural disasters, large-scale accidents, or other occasions that prevent delivery; VI - Strike or cessation of Correios activities; VII - Significant increase in Correios demand; VIII - Due to festive periods, such as Christmas and New Year's.

Paragraph Four: The deadline for product delivery is from 15 to 45 business days after posting, according to Correios rules. The deadline may be extended for up to 90 business days for the reasons stated in Paragraph Three of this clause.

Clause Seventh: This contract aims to ensure the facilitated attendance of the consumer, as provided for in item IV of article 4 of Decree No. 7,962/13.

Clause Eighth: SmartWayMl reserves the right to cancel the commercial transaction in the event that any situation is identified that characterizes fraud, bad faith, breach of any website conditions and policies, abuse of rights, and/or other situations that imply a violation of legal provisions or unjust enrichment.

Clause Ninth: The relationship between SmartWayMl and the user is regulated exclusively by the conditions established in this contract.

JURISDICTION

Clause Tenth: The jurisdiction to settle any issues concerning this contract will be that of the consumer's domicile.
